FarNote

Terms of Use

What FarNote is

FarNote carries postcards between people. You make a card where you are and address it to somebody, and it does not arrive at once: the farther it travels, the longer it takes.

"FarNote" means the app and the website together, including the page that shows a single postcard to the person it was sent to. Both are made and run by Babelo ("we", "us"). These terms apply wherever you use FarNote, together with the Privacy Policy.

FarNote is not a postal carrier and is not affiliated with any postal service. A card's arrival date is set when it is posted. Stamps, postmarks and the postbox are part of the product's design; they are not postage and have no cash value.

Your account

You sign in with Apple, with Google, or with a one-time link sent to your email; there is no password.

You must be at least 13 to have an account.

You are responsible for keeping access to the email address, or the Apple or Google account, you signed in with, because that is how you get back in. Your account is for you alone — do not share it or let someone else use it.

You may delete your account at any time, in Me → Account in the app or on the website. Deleting it removes your own copies of your cards, and cards still on their way never arrive. Postcards that have already been delivered stay with the people who received them: a card that has arrived is theirs, the same as one that came in the post.

What you send

Your cards are yours. The photos and words you put on a card remain yours.

To carry a card, FarNote needs a limited permission from you: to store it, carry it, and show it to the person you sent it to, on their phone — or, on a web page made for that one card, to whoever holds its link — and to have it reviewed if it is reported. That permission is only ever for carrying the card, and it ends when the card is deleted. FarNote will not use your photos or words to promote FarNote.

You are responsible for what you send. By posting a card you confirm that you have the right to send the photo and the words, and that sending them to that person is lawful where you both are. Once a card is posted, it cannot be edited.

What is not allowed

Do not use FarNote to:

If something on FarNote infringes your copyright or your trade mark, write to support@babelo.io with enough detail to find it. If the complaint is good, it comes down.

Reporting and blocking

FarNote has zero tolerance for content that sexualises a child, and for abuse. Every postcard you receive can be reported, and every sender can be blocked.

Reporting. Open a card and tap the ⋯ in the corner, or press and hold it on your shelf. Choose what is wrong with it and, if you like, tell us more. Your copy is deleted straight away unless you ask to keep it; FarNote keeps its own, so that the report can still be reviewed. On the website, Report writes to support@babelo.io. A person reads every report. FarNote cannot reply to each one, and a report is private: the person you report is never told who reported them.

A card that breaks these terms is removed, and the account that sent it may be stopped from posting, or closed — how far that goes depends on what was sent and on whether it has happened before. Content involving a child is not a matter of degree: it is removed at once, the account is closed, and it is reported to the authorities.

Blocking. Blocking somebody stops their postcards reaching you. They are not told, and their cards simply never arrive. Cards you already have stay where they are. You can undo it in Me → Blocked senders, but the cards that did not arrive while they were blocked do not arrive afterwards.

Deleting. Any card you were sent can be deleted without reporting anyone. That removes your copy and cannot be undone, and the sender is not told.

Reporting in bad faith — to harass someone, or in volume — is itself a breach of these terms. If you believe a decision about your own account was wrong, write to support@babelo.io.

Postcards to people not on FarNote

You can send a card to somebody who is not on FarNote. FarNote gives you a private link to that one card, and you send it to them yourself; FarNote does not contact them. A card's link is the key to that card: anyone who has it can read the card and keep it. Treat it the way you would treat the card itself, and send cards only to people who would welcome them.

Stamps and postmarks

Stamps and postmarks are part of the game. A postmark belongs to the one card and the one journey that earned it, and never appears on another. Neither can be bought or sold, or exchanged for anything outside FarNote, and neither has any cash value.

FarNote is free. If it ever charges for something, it will say so before you buy, and anything bought inside the app is bought through Apple.

Availability

FarNote may be unavailable, may lose features, and may change. Cards may be delayed by things outside anyone's control, and FarNote does not promise that a card will arrive at a particular moment.

If something goes wrong

FarNote is free, and it is provided as it is and as available. To the fullest extent the law allows, Babelo makes no promise about FarNote beyond what these terms say, and is not liable for indirect or consequential loss, or for the loss of postcards or other data. Where liability cannot be excluded, it is limited to US$50.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited, and nothing here removes rights you have as a consumer that cannot be removed by agreement.

Ending things

You may stop using FarNote and delete your account at any time. FarNote may suspend or close an account that breaks these terms, or that is used to harm someone.

Changes to these terms

If these terms change in a way that matters, FarNote will tell you before the change takes effect — in the app, or by email. Continuing to use FarNote after that means the new terms apply.

Apple

These terms are between you and Babelo, not between you and Apple, and Apple is not responsible for FarNote or for anything on it. Apple has no obligation to provide any maintenance or support for FarNote. If FarNote fails to conform to any warranty that applies, you may tell Apple, and Apple will refund the purchase price, if there was one; to the fullest extent the law allows, Apple has no other warranty obligation. Babelo, and not Apple, is responsible for any claim about the app — product liability, any failure to meet a legal requirement, anything arising under consumer protection or privacy law, and any claim by someone else that the app infringes their intellectual property. You confirm that you are not in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries of them.

The rest

If part of these terms turns out to be unenforceable, the rest still stands. Not enforcing a rule once does not give it up. These terms and the Privacy Policy are the whole agreement between you and Babelo about FarNote. You cannot transfer your account or this agreement to anyone else; Babelo may transfer it if the product changes hands, and will tell you before it does. If you send us an idea for FarNote we may use it and owe you nothing for it, so send us nothing you want to keep.

Governing law

These terms are governed by the law of the State of California, United States, where FarNote is run, and a dispute belongs to the state and federal courts in California. If you use FarNote as a consumer somewhere else, this does not take away the protections your own country's law gives you, or your right to bring a claim where you live.
